Mediation

What is Mediation?

Mediation is a voluntary, confidential, and affordable process for resolving conflict with the help of a neutral, trained professional. The mediator assists parties in creating their own agreements using a proven process which addresses the interests of all parties involved. Participants often leave with a greater understanding of the situation and a mutually satisfying resolution.

Types of Mediation

DIVORCE
I offer marriage, separation, and divorce mediation, including co-create parenting plans.
WORKPLACE
I offer workplace mediation for business, management, board, and employee disputes.
FAMILY
I offer family mediation including parent-teen, estate, siblings, and any extended family conflict
COUPLES
I offer partnership mediation for straight and same-sex couple.  I can help you feel heard.

Mediation FAQ's

Is mediation successful?
On average, parties that use mediation experience an 85% success rate in creating mutually acceptable settlements. Further, the majority of parties that don't come to agreement still indicate a high level of satisfaction with their experience.

How do I get started?
When you have a conflict and could use help in coming to an agreement, simply contact me.  During our conversation, you can speak directly and confidentially about your situation, ask questions, and get information about what to expect. If you choose to try mediation, we will contact the other party and assess their willingness to participate. With their consent, we will move forward to convene a mediation session for a day and time that works for both of you. 

Is it done remotely or in-person?
Mediation can be done in-person (locally in Bend, Oregon) or remotely (using a multi-party video conferencing software).


How much will it cost me?
Mediation fees are based upon a sliding scale, and can cost anywhere from $75 to $150 per hour.  Unless other arrangements are made, this free is usually split equally between the two parties.

What type of mediation do you use?
I practice Facilitative Interest-Based Mediation. Facilitative means the mediators provide a structure to help disputing parties communicate effectively with one another to develop their own resolutions. Interest-Based means that the mediators will assist parties in identifying and addressing the relevant issues and interests throughout the mediation process. Agreements reached using this model are usually durable and long lasting because the parties' needs in relation to the dispute are addressed as thoroughly as possible. Research has shown that the most durable and satisfactory agreements are ones that parties have collaboratively created themselves.

Conflict Coaching

Conflict coaching is defined as a set of skills and strategies used to support your ability to engage in, manage, or productively resolve conflict.  In this process, I will work one-on-one with you regarding the experience of conflict that you're having with another person.  Conflict coaching enables you to talk about the conflict with a neutral third party (me), consider options for managing the conflict, and design an approach to discuss the conflict with the other person.  Conflict coaching can be used as a stand-alone process, or can be practiced with each of the parties in separate meetings during mediation. 

Conflict coaching can be useful in a variety of circumstances, including conflicts in the workplace, supporting specific toxic employees to grow & change their behavior, divorce and post-decree situations, co-parenting, community disputes, family disagreements, or business conflicts.   In such situations, I can serve as a confidential listener, help you to see the situation from all perspectives, support you in considering options, and help you to come up with a plan of action to deal with the conflict.  I will provide skills to help you develop more clarity about the situation, enabling you to effectively and confidently make high-quality decisions to manage the conflict.  Additionally, I can help you rehearse a conversation so that you are prepared to more confidently enter into the conflict resolution discussion.

  • Gain clarity about your situation
  • Comprehend what is important for you
  • Define what you want the relationship to look like moving forward
  • Brainstorm options, and make choices about moving forward
  • Learn to manage your emotions, and use them as 'signposts' for your own personal growth.
  • Develop the confidence and competence to engage in negotiations with the other parties to the conflict.
